CHAPTER 1
An Act to amend and reenact §§ 8, as amended, and 15 of Chapter 78 of the Acts of Assembly of 1968,  which provided a charter for the City of Emporia, relating to council and mayoral elections.

Be it enacted by the General Assembly of Virginia:

1.  That §§ 8, as amended, and 15 of Chapter 78 of the Acts of Assembly of 1968 are amended and reenacted as follows:

§  (8)  Election and term of mayor and council.

The mayor and members of the Council in office at the time of the passage of this charter amendment shall continue in office until their successors have been elected and qualified as provided hereafter.

On May 10, 1988, or at such later date as described in the Consent Decree, four members of City Council shall be elected from districts for terms of office ending on June 30, 1990, and four members of City Council shall be elected from districts and the mayor elected at large for terms of office ending on June 30, 1992, except as otherwise provided in the Consent Order.  Thereafter, an election for the office of mayor shall be held every four years on the first Tuesday in May beginning in 1992, and there shall be an election on a staggered basis for members of Council every two years on the first Tuesday in May of each even-numbered year.  At the election to be held on the first Tuesday in May, 1990, the candidates elected to fill the four expiring terms shall be elected to four-year terms.  Thereafter, all members of Council shall be elected to four-year terms of office.

At the regular municipal election to be held on the first Tuesday after the first Monday in November 2006, and every two years thereafter, there shall be elected one council member from each district having an incumbent council member whose term expires on or before the first day of January next following such election. At the regular municipal election to be held on the first Tuesday following the first Monday in November 2008, and every four years thereafter, the mayor shall be elected at large. The mayor and members of the Council shall each serve for a term of four years commencing on the first day of January next following the date of their election and until their successors have been duly elected and qualified; provided, however, that the terms of the four council members subject to expire June 30, 2006, shall be extended to December 31, 2006, and the terms of the mayor and the three council members subject to expire June 30, 2008, shall be extended to December 31, 2008.

§  (15) Organization meeting. 

On the first Thursday in July January following the regular municipal election, the council shall meet in the council chambers at 7:30 P.M. at which time the newly elected councilmen and mayor, after first having taken the oath of office prescribed by law, shall assume the duties of their offices. Thereafter the council shall meet at such time as may be prescribed by ordinance or resolution, except that they shall meet regularly not less than once each month.

2. That an emergency exists and this act is in force from its passage.
