SUMMARY AS PASSED SENATE:
Consumer Protection Act; accrual of cause of action. Provides that a cause of action for violations of the Consumer Protection Act based upon misrepresentation, deception, or fraud accrues when such misrepresentation, deception, or fraud is discovered or, by the exercise of due diligence, reasonably should have been discovered.
SUMMARY AS INTRODUCED:
Accrual of cause of action. Provides that for violations of the Consumer Protection Act based upon misrepresentation, deception, fraud, false promises, false pretense or failure to disclose, the cause of action accrues when such misrepresentation, etc. is discovered or by the exercise of due diligence reasonably should have been discovered.
