AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 32.1-323.2, relating to medical assistance; employer information.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-323.2 as follows:

32.1-323.2. Department to collect and report on applicants' employment status.

A. The Department of Medical Assistance Services shall collect from the Department of Social Services any available information regarding full- or part-time employment of any applicant for health care benefits under public health programs, including the state plan for medical assistance services pursuant to this chapter, the State/Local Hospitalization Program under Chapter 12 (§ 32.1-343 et seq.), and the Family Access to Medical Insurance Security Plan under Chapter 13 (§ 32.1-351 et seq.). In the event the proposed beneficiary is not employed or is a minor, the applicant shall identify the employer of any adult in the household who is responsible for providing all or some of the proposed beneficiary's support.

B. By November 15 of each year, the Department of Medical Assistance Services shall prepare and submit a summary to the Governor and General Assembly of statistical data on the full- and part-time employment of applicants for public health programs and the costs of such beneficiaries' health care to the Commonwealth. The statistical summary of employment data on applicants for public health programs shall classify Virginia employers by categories, which shall be determined by the Director, and shall not include any personal identifiers, such as, but not limited to, the beneficiaries' names or addresses or health information or the employers' names or locations.

C. For purposes of this section, "proposed beneficiary" means (i) any individual who files an application for health care benefits for himself or (ii) any other individual on whose behalf an application for health care benefits is filed, including children or other dependents of the applicant or other individuals for whom the application is filed.

2.  That the provisions of this act shall expire on July 1, 2010.
