A BILL to amend and reenact § 54.1-703 of the Code of Virginia, as it is currently effective and as it shall become effective, and to amend the Code of Virginia by adding a section numbered 54.1-703:01, relating to the Department of Professional and Occupational Regulation, Board for Barbers and Cosmetology; designation of shop or salon.

Be it enacted by the General Assembly of Virginia:

1. That § 54.1-703, as it is currently effective and as it shall become effective, of the Code of Virginia is amended and reenacted, and that the Code of Virginia is amended by adding a section numbered 54.1-703:01 as follows:

§ 54.1-703. (Effective until July 1, 2004) License required; shop or salon designation.

A. No person shall offer to engage in or engage in barbering, cosmetology, nail care, waxing, or hair braiding without a valid license issued by the Board, except as provided in § 54.1-701.

B. No person shall be issued a license as a barber, cosmetologist or nail technician unless the applicant has designated to the Board the licensed barbershop, cosmetology salon or nail salon at which the applicant shall conduct his business. Such designation shall be certified by the shop or salon owner.

§ 54.1-703. (Effective July 1, 2004) License required shop or salon designation.

A. No person shall offer to engage in or engage in barbering, cosmetology, nail care, waxing, hair braiding, tattooing, or body-piercing without a valid license issued by the Board, except as provided in § 54.1-701.

B. No person shall be issued a license as a barber, cosmetologist or nail technician unless the applicant has designated to the Board the licensed barbershop, cosmetology salon or nail salon at which the applicant shall conduct his business. Such designation shall be certified by the shop or salon owner.

§ 54.1-703:01. Shop or salon designation required upon renewal.

Each barber, cosmetologist or nail technician applying for renewal shall be required to submit an updated designation indicating the licensed barbershop, cosmetology salon or nail salon at which the licensee shall conduct his business. Such designation shall be certified by the shop or salon owner.

2. That the provisions of this act shall become effective on July 1, 2005.

3. That the Board shall promulgate regulations to implement the provisions of this act to be effective on or before January 1, 2005.
