A BILL to amend and reenact § 22.1-4.3 of the Code of Virginia, relating to the provision of full and complete information to noncustodial parents by public or private schools or day care centers.

Be it enacted by the General Assembly of Virginia:

1. That § 22.1-4.3 of the Code of Virginia is amended and reenacted as follows:

§ 22.1-4.3. Participation in certain school or day care activities by noncustodial parent; information to be provided.

A. Unless a court order has been issued to the contrary, the noncustodial parent of a student enrolled in a public school or day care center shall not be denied the opportunity to participate in any of the student's school or day care activities in which such participation is supported or encouraged by the policies of the school or day care center solely on the basis of such noncustodial status.

B. Further, unless a court order has been issued to the contrary, the noncustodial parent of a student enrolled in any public or private elementary, middle, or high school or day care center shall be provided the full and complete information concerning the child's school or day care activities, scholastic record, test results, academic achievement and progress, and school behavior in the same manner and form as is provided to the custodial parent by the public or private elementary, middle, or high school or day care center.

C. For the purposes of this section, "school or day care activities" shall include, but shall not be limited to, lunch breaks, special in-school programs, parent-teacher conferences and meetings, and extracurricular activities. It is the responsibility of the custodial parent to provide the court order to the school or day care center.
