Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 23-9.6:3 as follows:

§ 23-9.6:3. Designation of certain student fees.

The State Council of Higher Education shall develop guidelines for procedures for the designation by students of that portion of mandatory student fees not applied to educational or auxiliary programs, athletic teams and programs, student health services, or student activities, for donation to approved, tax-exempt charitable and civic organizations. The State Council shall develop and maintain a list of charitable or civic organizations approved for such designated fees. Such procedures shall provide for the automatic application of such fee portion to men's and women's athletic programs, including intercollegiate and intramural activities, in the event the student fails to designate an approved recipient.

The relevant boards of visitors shall implement procedures consistent with such guidelines for students to designate that portion of any student fees not applied to educational or auxiliary programs, athletic teams and programs, student health services, or student activities, for donation to approved, tax-exempt charitable and civic organizations.
