A BILL to amend the Code of Virginia by adding in Article 4 of Chapter 3 of Title 58.1 a section numbered 58.1-346.25, relating to voluntary contributions of income tax refunds for certain cultural organizations located in the western region of the Commonwealth.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Article 4 of Chapter 3 of Title 58.1 a section numbered 58.1-346.25 as follows:

§ 58.1-346.25. Voluntary contribution to promote western Virginia cultural organizations.

A. Any individual eligible to receive a tax refund pursuant to § 58.1-309 may designate at the time of filing a return a specified dollar amount of such refund, not less than $1, to be used by the following organizations in promoting the arts in the western region of the Commonwealth: Art Museum of Western Virginia, Arts Council of the Blue Ridge, Center in the Square, Harrison Museum of African American Culture, History Museum & Historical Society of Western Virginia, Jefferson Center Foundation, Mill Mountain Theatre, Mill Mountain Zoo, Opera Roanoke, Roanoke Ballet Theatre, Roanoke Symphony, Salem Museum, Science Museum of Western Virginia, Southwest Virginia Ballet, To the Rescue Museum, Virginia Explore Park, and Virginia Museum of Transportation.

B. All moneys collected pursuant to subsection A shall be deposited into the state treasury.

C. The Tax Commissioner shall determine annually the total amount designated on all returns and shall report the same to the State Treasurer, who shall credit the amount to a special fund known as the Western Virginia Region Cultural Organizations Fund which special fund is hereby established. The amount in the Fund shall be divided equally and distributed annually among the organizations listed in subsection A.
