051524302Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 1 of Title 22.1 a section numbered 22.1-7.1 as follows:
§ 22.1-7.1. Participation in public school interscholastic activities by students receiving home instruction and charter school students.
Any nonprofit corporation founded in Virginia in 1913 that currently organizes and governs interscholastic activities among the public high schools shall develop, implement, and enforce an exception to its rules addressing enrollment and the eligibility of regular, bona fide students for participation in interscholastic activities. Such exception shall provide eligibility for participation in interscholastic sports by (i) any student receiving home instruction pursuant to § 22.1-254.1 who has been receiving such instruction for at least one year prior to eligibility and is entitled to free tuition in such public school pursuant to § 22.1-5, and (ii) any student enrolled in a charter school that does not sponsor or provide those interscholastic activities or teams in which the student desires to participate. Such eligibility shall be limited to participation in interscholastic activities at the school serving the attendance zone in which such student lives.
