056626538Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 46.2-400.1 as follows:
§ 46.2-400.1. Issuance of restricted licenses for traffic offenses generally.
In any case where a person commits a traffic offense, whether an infraction or a misdemeanor, and the court suspends the offender's license to operate a motor vehicle, the court may also issue a restricted operator's license for any of the purposes set forth in, and in accordance with the procedures of, subsection E of § 18.2-271.1. No such restricted license may be issued pursuant to this section if the law under which the offender was convicted sets forth specific terms of restricted licensure or provides that no restricted license may be issued. The court may impose additional terms and conditions upon the restricted license as are consistent with the case.
