No such lien shall be filed in a circuit court of the Commonwealth. Any such lien filed or notice served contrary to the provisions of this paragraph shall be null and void and without legal effect. Any person or entity filing such a lien or causing such a notice to be served may be subject to a civil penalty of $100. Civil penalties collected under the provisions of this paragraph shall be deposited into the Home Energy Assistance Fund established pursuant to § 63.2-805.
