That any rights, claims, or defenses arising out of the general permit authorized under this act or arising out of Article 3.04 (§ 62.1-44.19:12 et seq.) of Chapter 3.1 of Title 62.1 of this act, shall not be applicable to, raised nor asserted in any judicial proceeding, or appeals therefrom, that relate to Virginia Pollutant Discharge Elimination System permits issued by the Board on June 17, 2004.
