2004 SESSION
SB 647 Grievance procedures; hearing decisions.
Introduced by: W. Roscoe Reynolds | all patrons ... notes | add to my profiles
SUMMARY AS INTRODUCED:
State Grievance Procedure; decisions. Provides that failure of the employee or the agency to comply with a substantial procedural requirement of the grievance procedure without just cause shall result in a decision against the noncomplying party on any qualified issue. Under current law such failure is not required to result in a decision against the noncomplying party. The bill also provides that the decision of the hearing officer shall be binding upon the agency. Under current law, the decision is binding upon the agency if it is consistent with law and policy. In addition, the bill removes the provision requiring the Director of the Department of Human Resource Management to determine within 60 days of the decision whether the decision is consistent with policy.
