SUMMARY AS PASSED HOUSE:
Unlawful filming, videotaping or photographing of child; penalty. Provides that videotaping, photographing or filming a nude or undergarment-clad nonconsenting person under the age of 18, under circumstances where the person would have a reasonable expectation of privacy, is punishable as a Class 6 felony. Currently, the offense is a Class 1 misdemeanor without regard to the age of the nonconsenting person.
SUMMARY AS INTRODUCED:
Unlawful filming, videotaping or photographing of another; penalty. Provides that videotaping a nude or undergarment-clad nonconsenting person under the age of 18 is punishable as a Class 6 felony and a second or subsequent violation shall be punishable as a Class 5 felony. Currently, the offense is a Class 1 misdemeanor without regard to the age of the nonconsenting person.
