SUMMARY AS INTRODUCED:
Damages recoverable for encroachment in timber cutting. Allows a person whose timber is cut without permission to pursue damages based upon a rebuttable presumption that the timber cutter is fully liable for double damages unless he provides written notice of his intent to cut timber upon land clearly marked and claimed as his at least 10 days prior to beginning operations, without objection from the adjacent landowner.
