047415792Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-226.8 as follows:
§ 8.01-226.8. Civil immunity for officials participating in roadway litter pick-up program for probationers.
[ Judges, probation Probation ] officers, court personnel, county, city and
town personnel and any other public officials who participate in a program where persons on probation are ordered as
a condition of probation to pick up litter along a section of public roadway or
waterway shall not be liable for any civil damages to a probationer or his
property for acts or omissions resulting from such participation, unless such
act or omission is the result of the public official's willful misconduct. The
provisions of this section shall not be interpreted to grant any immunity to a
motorist who, by his negligence, may injure such probationer.
