AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 46.2-749.43:1 and by adding in Article 10 of Chapter 6 of Title 46.2 sections numbered 46.2-749.101 through 46.2-749.109, and to repeal § 46.2-749.43 of the Code of Virginia, relating to special license plates; the 200th anniversary of the Town of Occoquan; the POW/MIA logo; supporters of Virginia agriculture; the 275th anniversary of the County of Prince William; supporters of the Blue Ridge Parkway Foundation; organ donor programs; barbershop quartet singing enthusiasts; supporters of the Washington D.C. United soccer team; supporters of the Canine Health Foundation; supporters of children with special needs; fees.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-749.43:1 and by adding in Article 10 of Chapter 6 of Title 46.2 sections numbered 46.2-749.101 through 46.2-749.109 as follows:

§ 46.2-749.43:1. Special license plates; POW/MIA logo.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates bearing the POW/MIA logo.

§ 46.2-749.101. Special license plates; 200th anniversary of the Town of Occoquan.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates commemorating the 200th anniversary of the Town of Occoquan.

The provisions of this section shall expire on July 1, 2009.

§ 46.2-749.102. Special license plates; supporters of Virginia agriculture; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue special license plates to supporters of Virginia agriculture.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Virginia Agricultural Vitality Program Fund, established within the Department of Accounts. These funds shall be paid annually to the Office of Farm Land Preservation and used to the Virginia Agricultural Vitality Program Fund.

§ 46.2-749.103. Special license plates; 275th anniversary of the County of Prince William.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates commemorating the 275th anniversary of the County of Prince William.

The provisions of this section shall expire on July 1, 2009.

§ 46.2-749.104. Special license plates; Blue Ridge Parkway Foundation; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue special license plates to supporters of the Blue Ridge Parkway Foundation.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Blue Ridge Parkway Foundation Fund, established within the Department of Accounts. These funds shall be paid annually to the Blue Ridge Parkway Foundation and used to support its programs and activities in Virginia.

§ 46.2-749.105. Special license plates to encourage participation in the organ donor program.

On receipt of an application therefor, the Commissioner shall issue special license plates that encourage participation by Virginia-licensed drivers in the organ donor program.

§ 46.2-749.106. Special license plates; barbershop quartet singing enthusiasts.

On receipt of an application therefor, the Commissioner shall issue special license plates to barbershop quartet singing enthusiasts.

§ 46.2-749.107. Special license plates for supporters of the Washington D.C. United soccer team.

On receipt of an application therefor, the Commissioner shall issue special license plates to supporters of the Washington D.C. United soccer team.

§ 46.2-749.108. Special license plates; supporters of the Canine Health Foundation; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue special license plates to supporters of the Canine Health Foundation.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Canine Health Foundation Fund, established within the Department of Accounts. These funds shall be paid annually to the Canine Health Foundation and used to support its programs and activities in Virginia.

§ 46.2-749.109. Special license plates; children with special needs; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue to the applicant special license plates bearing the legend: CHILDREN WITH SPECIAL NEEDS.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Snap4kids Fund, established within the Department of Accounts. These funds shall be paid annually to Snap4kids and used to support its programs and activities in Virginia.

2. That § 46.2-749.43 of the Code of Virginia is repealed.
