Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-190.01 as follows:

§ 33.1-190.01. Performance of certain engineering functions prohibited.

Notwithstanding any contrary provision of this title, except for (i) functions explicitly required by §§ 33.1-192 and 46.2-1104 to be performed by the Department's chief engineer and (ii) projects undertaken as provided in § 33.1-190, no engineering functions shall be carried out by Department employees in connection with the planning, designing, construction, reconstruction, or maintenance of any highway or highway component constituting a part of the interstate, primary, or national highway system. Any such engineering functions shall be performed by engineers or engineering businesses that are insured and licensed to do business in the Commonwealth, pursuant to written contracts wherein the Department is the general contractor and the engineers or engineering businesses are subcontractors.
