046581460Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding sections numbered 38.2-1912.2 and 38.2-2005.1 as follows:
§ 38.2-1912.2. Capping of workers' compensation voluntary market rates and loss costs for coal mining classifications.
Notwithstanding the provisions of § 38.2-1904, voluntary market rates and loss costs for workers' compensation insurance for both the underground and surface coal mining classifications shall be capped at the level applicable on July 1, 2004, until such time as the General Assembly shall authorize a rate increase. Nothing herein shall limit the Commission's authority to approve rate or loss costs decreases for such classifications.
§ 38.2-2005.1. Capping of workers' compensation insurance rates for coal mining classifications written through the Virginia Workers' Compensation Insurance Plan.
Notwithstanding the provisions of § 38.2-2005, rates for workers' compensation insurance written through the Virginia Workers' Compensation Insurance Plan for both the underground and surface coal mining classifications shall be capped at the level applicable on July 1, 2004, until such time as the General Assembly shall authorize a rate increase. Nothing herein shall limit the Commission's authority to approve rate decreases for such classifications.
