Be it enacted by the General Assembly of Virginia:

1. That § 20-15 of the Code of Virginia is amended and reenacted as follows:

§ 20-15. Tax on license.

1. On each marriage license issued under § 20-14 there is hereby levied a license tax of twenty dollars$20, which tax shall be collected by the clerk when the license is issued and accounted for as in the case of other state taxes collected by him.

2. If, prior to the issuance of the license, the applicants have received four hours of counseling concerning the nature and responsibilities of the marital relationship, the payment of the license tax required in subdivision 1 shall be waived, provided that, (i) the parties contemplating marriage state under oath that they have received such counseling and present as part of their application for a marriage license a notarized attestation, signed by the person performing the counseling, confirming that the parties were counseled as required herein and (ii) the counseling was performed by a person who is authorized to perform a marriage ceremony or by a licensed or by a licensed professional counselor or marriage and family therapist as defined in § 54.1-3500.
