044006428Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 1 of Title 35.1 a section numbered 35.1-10.1 as follows:
§ 35.1-10.1. Prevention of noise-induced hearing loss.
Any entity subject to licensure pursuant to this title that contracts for events including live or recorded musical entertainment that may or will exceed the maximum noise level of 80 decibels, or such other lower noise level as the Board of Health shall determine, at which noise-induced hearing loss occurs, shall, as a condition of obtaining or renewing such licensure, offer and make available with or without charge individual hearing protection devices, such as earplugs, to patrons upon admission to events including such musical entertainment.
