Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-23.1:01 as follows:

§ 33.1-23.1:01. "Smart Road" construction fund.

Before funds are allocated for distribution for highway construction pursuant to subdivisions B 1, B 2, and B 3 of § 33.1-23.1, a fund shall be established for paying the costs of construction, reconstruction, and improvement projects involving the "Smart Road" at the Virginia Tech Transportation Institute. Prior to the beginning of each fiscal year, there shall be allocated to such fund a sum sufficient to cover the costs of all construction, reconstruction, and improvement projects involving the "Smart Road" to be undertaken in the coming fiscal year.
