Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 10.1-2135 as follows:

§ 10.1-2135. Water quality improvement fee.

A. Every locality shall assess and collect from every owner of improved real estate assessed by the locality at a value of more than $60,000 a $1 per month water quality improvement fee. The locality shall remit the moneys generated from the fee to the State Treasurer, for deposit in the Water Quality Improvement Fund established by § 10.1-2128. Payment shall be made within 30 days of the end of each quarter, with the first payment due by October 30, 2004. The locality may, on a quarterly basis, withhold $10,000 or three percent of the amount due, whichever is less, for the purpose of covering administrative costs associated with the remittance of the fee to the Commonwealth.

B. In addition to the fee assessed in subsection A, the locality shall assess and collect from such property owners who are served by a publicly owned treatment work an additional $1 per month. Payment shall be made within 30 days of the end of each quarter, with the first payment due by October 30, 2004. The locality may, on a quarterly basis, withhold $10,000 or three percent of the amount due, whichever is less, for the purpose of covering administrative costs associated with the remittance of the fee to the Commonwealth.

C. The moneys remitted to the Water Quality Improvement Fund pursuant to this section shall be allocated in the following manner:

1. Seventy percent shall be allocated for point source pollution funding pursuant to § 10.1-2131; and

2. Thirty percent shall be allocated for nonpoint source pollution funding pursuant to § 10.1-2132.
