040950408Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-42.4 as follows:
§ 8.01-42.4. Violent felony bar to action against victim for personal injury, wrongful death or damage to property.
In any civil action in which it is alleged that personal injury, death by wrongful act or damage to property has resulted from the negligence of the victim of a violent felony as defined in § 17.1-805, it shall be a defense to such action that the injury, death by wrongful act or damage to property occurred during the commission of a violent felony committed by the plaintiff.
