Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 24.2-701.1 as follows:

§ 24.2-701.1. Solicitation of absentee ballot applications and ballots in hospitals, nursing homes, and assisted living facilities.

It shall be unlawful for any person to solicit, in person, absentee ballot applications or absentee ballots from persons staying in any hospital or nursing home as defined in § 32.1-123 or assisted living facility as defined in § 63.2-100. The prohibition in this section shall not apply to (i) a family member of the person staying in the hospital, nursing home, or assisted living facility, (ii) a general or assistant registrar or the members of the electoral board for a locality, or (iii) the staffs of the general registrar or electoral board. "Family member" means a spouse, parent, grandparent, sibling, child, or grandchild.
