044265536Be it enacted by the General Assembly of Virginia:
1. That §§ 23-296 and 23-297 of the Code of Virginia are amended and reenacted as follows:
§ 23-296. Frontier Culture Museum of Virginia created; purpose.
There is hereby created and constituted an educational institution of the
Commonwealth to be known as the "Frontier Culture Museum of Virginia as a state
agency," hereinafter referred to as the "Museum." The purpose of the museum is
to construct, operate, and maintain, in the Augusta County/Staunton/Waynesboro
area Augusta County, Staunton, and Waynesboro areas of the Commonwealth, an
outdoor museum in order to commemorate on an international scale the
contribution which that the pioneers and colonial frontiersmen and
frontierswomen of the eighteenth and nineteenth centuries made to the creation and development of the
United States. The Museum is an educational institution with responsibility to
shall administer certain historical and interpretive programs as may
be established.
§ 23-297. Board of Trustees; membership; terms; officers and committees; compensation.
A. The Frontier Culture Museum of Virginia shall be administered by a Board of
Trustees consisting of no more than twenty-five 13 members. The members shall
that include six legislative members and seven nonlegislative citizen members
to be appointed as follows: five four members of the House of Delegates
shall to be appointed by the Speaker of the House of Delegates, in
accordance with the principles of proportional representation contained in the Rules of the House of
Delegates; three two members of the Senate shall to be appointed by the Senate
Committee on Privileges and Elections; and nine seven nonlegislative citizen
members shall to be appointed by the Governor, subject to confirmation by the
General Assembly.
B. Legislative members shall serve terms coincident with their terms of
office. Members appointed by the Governor shall serve terms as follows: three
members shall serve for one year, two members shall serve for two years, two
members shall serve for three years, and two members shall serve for four
years. Thereafter, members appointed shall serve for four-year terms.
Appointments to fill vacancies, other than by expiration of a term, shall be
made for the unexpired term. The Governor may appoint, upon recommendation
of the Board of Trustees, eight additional members for four-year terms who may be
nonresidents of the Commonwealth and who shall serve at no expense to the
Commonwealth.terms. All members may be reappointed. However, no House
member shall serve more than four consecutive two-year terms, no Senate member shall serve more
than two consecutive four-year terms, and no nonlegislative citizen member
appointed by the Governor shall serve more than two consecutive four-year
terms. The remainder of any term to which a member is appointed to fill a
vacancy shall not constitute a term in determining the member's eligibility for
reappointment. Vacancies shall be filled in the same manner as the original
appointments. Nonlegislative citizen members may be nonresidents of the
Commonwealth.
C. The Board of Trustees shall elect a chairman, vice-chairman vice chairman,
and such other officers from among its membership as it deems necessary. A
majority of the members shall constitute a quorum. The Board of Trustees shall
meet at least four times each year. The meetings of the Board shall be held at
the call of the chairman or whenever the majority of the members so request.
Seven or more of the members of the Board of Trustees shall constitute an
executive committee.
D. The Legislative members of the Board of Trustees shall be reimbursed for
actual expenses and shall be compensated at the per diem rate established for
members of the General Assembly for meetings receive such compensation as
provided in § 30-19.12, and shall be reimbursed for reasonable and
necessary expenses incurred in the performance of their duties as provided in
§§ 2.2-2813 and 2.2-2825. However, nonlegislative citizen members
shall not be eligible to receive compensation or reimbursement of expenses.
Funding for the costs of compensation and expenses of the members shall be provided
by the Office of the Secretary of Education.
The Office of the Secretary of Education shall provide staff support to the Board of Trustees. All agencies of the Commonwealth shall provide assistance to the Board of Trustees, upon request.
The chairman of the Board of Trustees shall submit to the Governor and the General Assembly an annual executive summary of the interim activity and work of the Museum no later than the first day of each regular session of the General Assembly. The executive summary shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.
2. That, the current membership of the Board of Trustees shall continue to serve until their respective terms expire. On July 1, 2004, the Board of Trustees shall consist of 13 members, of whom seven shall be nonlegislative citizen members.
