HOUSE BILL NO. 1016 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the House Committee on Commerce and Labor on February 10, 2004) (Patron Prior to Substitute--Delegate Dillard) A BILL to amend and reenact § 38.2-3525 of the Code of Virginia, relating to group accident and sickness insurance; persons covered.

Be it enacted by the General Assembly of Virginia:

1. That § 38.2-3525 of the Code of Virginia is amended and reenacted as follows:

§ 38.2-3525. Group accident and sickness insurance coverage for spouses, dependent children, and other persons.

A. Coverage At the insurer's option and subject to the policyholder's election, coverage under a group accident and sickness insurance policy, except a policy issued pursuant to § 38.2-3521.1 B, may be extended to insure any or all of the following persons:

1. The spouse and of any insured group member who so elects;

any 2. Any child of any insured group member, provided that any such dependent coverage shall include all children of the insured group member, at the insured group member's election, who is are under the age of nineteen 19 years or who is a dependent are dependents and a full-time student students under twenty-five25 years of age, without regard to whether such child resides children reside in the same household as the certificate holder insured group member, or any of class of spouse and dependent children, older than the ages established above of each insured group member who so elects as may mutually be agreed upon by the insurer and the group policyholder; or

3. Any other person who the insured group member elects, provided that the extension of coverage to such person is made with the concurrence of the insurer and the group policyholder.

B. The amount of accident and sickness insurance for the spouse or, dependent child, or other person approved for coverage pursuant to this section shall not exceed the amount of accident and sickness insurance for the insured group member.

B C. Notwithstanding the provisions of § 38.2-3538, one certificate may be issued for each family unit insured group member if a statement concerning coverage of any spouse's or dependent child's coverage spouse, dependent child or other individual included pursuant to this section is included in the certificate.
