CHAPTER 984
An Act to amend and reenact §§ 46.2-737, 46.2-746.4, 46.2-746.9, 46.2-749.59, and 46.2-749.62 of the Code of Virginia, to amend the Code of Virginia by adding sections numbered 46.2-742.4, 46.2-746.2:2.2, 46.2-746.2:5, 46.2-746.4:01, 46.2-746.8:2, 46.2-749.28:2, 46.2-749.30:2, 46.2-749.69:1, and 46.2-749.98:1 and by adding in Article 10 of Chapter 6 of Title 46.2 sections numbered 46.2-749.101 through 46.2-749.109, and to repeal §§ 46.2-742.3, 46.2-746.2:2.1, 46.2-749.28:1, 46.2-749.69, and 46.2-749.98 of the Code of Virginia, relating to special license plates; supporters of adoption programs offered by the Virginia Department of Social Services and licensed Virginia nonprofit child-placing services, the Virginia Motor Sports Initiative, Mothers Against Drunk Driving, Project Lifesaver, the Interdenominational Children's Foundation of Virginia, the Boy Scouts of America, and the Juvenile Diabetes Research Foundation; supporters of court-appointed special advocate programs; members of the American Legion; special license plates whose design incorporates the flag of the United States and the legend: FIGHT TERRORISM; commemorating the 200th anniversary of the Town of Occoquan, the 350th anniversary of the County of New Kent, the 150th anniversary of Burke's Station, and the 275th anniversary of the County of Prince William; retired law-enforcement officers; U.S. Navy chief petty officers; bicycle enthusiasts; Langley Air Force Base; paratroopers; persons awarded the Combat Infantryman Badge; and general registrars; fees.

Be it enacted by the General Assembly of Virginia:

1. That §§ 46.2-737, 46.2-746.4, 46.2-746.9, 46.2-749.59, and 46.2-749.62 of the Code of Virginia are amended and reenacted, and that the Code of Virginia is amended by adding sections numbered 46.2-742.4, 46.2-746.2:2.2, 46.2-746.2:5, 46.2-746.4:01, 46.2-746.8:2, 46.2-749.28:2, 46.2-749.30:2, 46.2-749.69:1, and 46.2-749.98:1 and by adding in Article 10 of Chapter 6 of Title 46.2 sections numbered 46.2-749.101 through 46.2-749.109 as follows:

§ 46.2-737. Special license plates for certain constitutional officers.

The Commissioner, on application, shall issue to sheriffs, county and city treasurers and commissioners of the revenue, attorneys for the Commonwealth, and circuit court clerks, and general registrars special license plates identifying the office held by the applicant.

The provisions of subdivisions 1 and 2 of subsection B of § 46.2-725 shall not apply to license plates issued under this section.

§ 46.2-742.4. Special license plates for persons awarded the Combat Infantryman Badge.

On receipt of an application and written evidence that the applicant has been awarded the Combat Infantryman Badge, the Commissioner shall issue to the applicant special license plates.

§ 46.2-746.2:2.2. Special license plates; paratroopers.

On receipt of an application therefor and presentation of written evidence that the applicant is a paratrooper or former paratrooper, the Commissioner shall issue to the applicant special license plates.

§ 46.2-746.2:5. Special license plates; U.S. Navy chief petty officers.

On receipt of an application therefor and presentation of written evidence that the applicant is or has been a chief petty officer in the U.S. Navy, the Commissioner shall issue to the applicant special license plates.

§ 46.2-746.4. Special license plates for members of certain military veterans' organizations.

On receipt of an application and written evidence that the applicant is a member of any of the following military veterans' organizations, the Commissioner shall issue special license plates to the members of the following organizations: the American Legion, the Legion of Valor of the USA, the Marine Corps League, the Retired Officers Association, the Veterans of the Battle of Iwo Jima, and the Vietnam Veterans of America.

The provisions of subdivisions 1 and 2 of subsection B of § 46.2-725 shall not apply to license plates issued to members of the Legion of Valor of the USA under this section.

§ 46.2-746.4:01. Special license plates for members of the American Legion.

On receipt of an application and written evidence that the applicant is a member of the American Legion, the Commissioner shall issue special license plates to members of the American Legion.

§ 46.2-746.8:2. Special license plates; retired law-enforcement officers.

On receipt of an application and written evidence that the applicant is a retired sworn law-enforcement officer, the Commissioner shall issue to the applicant special license plates.

§ 46.2-746.9. Special license plates for certain occupations.

On receipt of an application and written evidence that the applicant is a printer, magistrate, medical doctor, teacher, pharmacist, registered nurse, general registrar, or postmaster, the Commissioner shall issue special license plates to the applicant.

§ 46.2-749.28:2. Special license plates; Langley Air Force Base.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates bearing the legend: LANGLEY AIR FORCE BASE.

§ 46.2-749.30:2. Special license plates; supporters of the Boy Scouts of America.

On receipt of an application therefor, the Commissioner shall issue special license plates to supporters of the Boy Scouts of America.

§ 46.2-749.59. Special license plates; supporters of court-appointed special advocate programs; fees.

A. On receipt of an application, and payment of the fee prescribed by this section, and written evidence that the applicant is a member or associate of the Virginia Court Appointed Special Advocate Association, the Commissioner shall issue special license plates to members and associates supporters of the Virginia Court Appointed Special Advocate Association court-appointed special advocate programs.

B. The annual fee for plates issued pursuant to this section shall be twenty-five dollars $25 in addition to the prescribed fee for state license plates. For each such twenty-five dollar $25 fee collected in excess of 1,000 registrations pursuant to this section, fifteen dollars $15 shall be paid into the state treasury. These moneys shall be paid annually to the Department of Criminal Justice Services to be used to fund Court Appointed Special Advocate Programs court-appointed special advocate programs in Virginia.

§ 46.2-749.62. Special license plates whose design incorporates the flag of the United States.

A. On receipt of an application therefor, the Commissioner shall issue special license plates whose design incorporates the flag of the United States and the legend: FIGHT TERRORISM.

B. On receipt of an application therefor from a member of the Senate or House of Delegates, the Commissioner shall issue to the applicant special license plates combining the designs of special license plates issued under subsection A of this section and special license plates issued to members of the Senate or House of Delegates, as the case may be, under § 46.2-736.1.

§ 46.2-749.69:1. Special license plates for supporters of the Virginia Motor Sports Initiative; special license plates bearing the names, numbers, and color schemes used by professional stock car drivers; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue special license plates to supporters of the Virginia Motor Sports Initiative.

The provisions of subdivisions 1 and 2 of subsection B of § 46.2-725 shall apply to license plates issued under this subsection.

B. On receipt of a minimum of 350 prepaid applications and a design therefor, together with signed releases from the driver, his team, and sponsors permitting the use of such design and all elements thereof without cost, including the payment of royalties, to the Commonwealth, the Commissioner may develop and issue one or more series of special license plates bearing the name of a specific professional stock car driver and the race car number and color scheme used by that driver. Each driver-specific series developed and issued under this subsection shall be subject to the requirements of this subsection. In the event that a race car number, color scheme, or both, change for a driver with a currently issued series, a new series for that driver may be issued subject to the requirements of this subsection.

The provisions of subdivision 1 of subsection B of § 46.2-725 shall not apply to license plates issued under this subsection.

C. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to the special nonreverting fund known as the Virginia Motor Sports Initiative Fund established within the Department of Accounts and paid annually in equal amounts to the Virginia Economic Development Partnership Authority and the Virginia Department of Business Assistance and used to support their programs related to the Virginia Motor Sports Initiative.

§ 46.2-749.98:1. Special license plates; Interdenominational Children's Foundation of Virginia; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue to the applicant special license plates for supporters of the Interdenominational Children's Foundation of Virginia.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Interdenominational Children's Foundation of Virginia Fund, established within the Department of Accounts. These funds shall be paid annually to the Interdenominational Children's Foundation of Virginia and used to support the Foundation's activities and programs.

§ 46.2-749.101. (Expires July 1, 2009) Special license plates; 275th anniversary of the County of Prince William.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates commemorating the 275th anniversary of the County of Prince William.

The provisions of this section shall expire on July 1, 2009.

§ 46.2-749.102. Special license plates for bicycle enthusiasts.

On receipt of an application therefor, the Commissioner shall issue special license plates to bicycle enthusiasts.

§ 46.2-749.103. Special license plates; supporters of adoption programs; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue special license plates to supporters of adoption programs.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Virginia Department of Social Services Adoption Programs Fund, established within the Department of Accounts. These funds shall be paid annually to the Virginia Department of Social Services and used (i) to support its adoption programs and (ii) to develop a grants program that shall provide all licensed Virginia nonprofit child-placing services a means to apply for portions of such funds to support their child placement programs and activities in Virginia.

§ 46.2-749.104. (Expires July 1, 2009) Special license plates; 200th anniversary of the Town of Occoquan.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates commemorating the 200th anniversary of the Town of Occoquan.

The provisions of this section shall expire on July 1, 2009.

§ 46.2-749.105. Special license plates; Mothers Against Drunk Driving; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue special license plates to supporters of Mothers Against Drunk Driving.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Mothers Against Drunk Driving Fund, established within the Department of Accounts. These funds shall be paid annually to Mothers Against Drunk Driving and used to support its programs and activities in Virginia.

§ 46.2-749.106. Special license plates; supporters of Project Lifesaver.

On receipt of an application therefor, the Commissioner shall issue special license plates to supporters of Project Lifesaver.

§ 46.2-749.107. Special license plates; Juvenile Diabetes Research Foundation; fees.

A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue to the applicant special license plates for supporters of the Juvenile Diabetes Research Foundation.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the Juvenile Diabetes Research Foundation Fund, established within the Department of Accounts. These funds shall be paid annually to the Juvenile Diabetes Research Foundation and used to support its programs and activities in Virginia.

§ 46.2-749.108. (Expires July 1, 2009). Special license plates; 350th anniversary of the County of New Kent.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates commemorating the 350th anniversary of the County of New Kent.

The provisions of this section shall expire on July 1, 2009.

§ 46.2-749.109. (Expires July 1, 2009). Special license plates; 150th anniversary of Burke's Station.

On receipt of an application therefor, the Commissioner shall issue to the applicant special license plates commemorating the 150th anniversary of Burke's Station.

The provisions of this section shall expire on July 1, 2009.

2. That §§ 46.2-742.3, 46.2-746.2:2.1, 46.2-749.28:1, 46.2-749.69, and 46.2-749.98 of the Code of Virginia are repealed.
