B. In such cases where the employer institutes an action against any party to recover some or all of its lien as set forth by subsection D of § 65.2-309, the employer shall not be required under this section to bear any share of the reasonable legal expenses of such employee, personal representative, or other person for that portion of its lien which is not preserved by the employee, his personal representative or other person.
