SB 1290 Occupancy permits.

SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION:
Board for Contractors; exemptions; penalty. Provides that any person exempt from licensure as a contractor because they are building a residence on their own property must obtain a certificate of occupancy prior to conveying it to a third party purchaser unless the purchaser consents to the purchase without the certificate of occupancy being issued. The bill also provides that any person found to have violated this requirement shall be guilty of a Class 1 misdemeanor. The third or any subsequent conviction during a 36-month period shall constitute a Class 6 felony.
SUMMARY AS PASSED:
Occupancy permits. Provides that the disclaimer or disclosure form provided by the seller in a residential sale to inform the purchaser that the seller must provide a copy of the certificate of occupancy to the purchaser upon closing, unless the purchaser has acknowledged in writing that the certificate of occupancy has not been issued at the time of the purchase.

Occupancy permits. Provides that the disclaimer or disclosure form provided by the seller in a residential sale to inform the purchaser that the seller must provide a copy of the certificate of occupancy to the purchaser upon closing.

Occupancy permits. Requires the local building official to file the final occupancy permit with the clerk of the circuit court for the locality.
