SUMMARY AS PASSED:
Crime victim rights. Adds a child's foster parents or other custodians to the definition of "victim" in the Crime Victim and Witness Rights Act for the purpose of offering victim input at the proceedings. Persons so defined have the right to remain in the courtroom, to submit a victim impact statement and to testify at a sentencing hearing. This bill arises out of an Alexandria case in which a foster mother was unable to testify at the sentencing hearing of the man convicted of killing her foster daughter. This bill is identical to HB 2379.
SUMMARY AS INTRODUCED:
Crime victim rights. Adds a child's foster parents or other custodians to the definition of "victim" in the Crime Victim and Witness Rights Act. Persons defined as victims have the right to notification, to be consulted about plea agreements in felony cases, to remain in the courtroom, to submit a victim impact statement and to testify at a sentencing hearing. This bill arises out of an Alexandria case where a foster mother was unable to testify at the sentencing hearing of the man convicted of killing her foster daughter.
