SUMMARY AS PASSED HOUSE:
Health; restaurant public disclosure system. Provides that the provisions of the Administrative Process Act do not apply to the adoption of the FDA Food Code by the Department of Agriculture and Consumer Services and the Department of Health. The bill does require the Departments of Agriculture and Consumer Services and Health to publish an opportunity for public comment prior to adopting these regulations.
SUMMARY AS INTRODUCED:
Health; restaurant public disclosure system. Provides for the development of a public disclosure system for restaurant and retail food store health inspections, requiring the posting of placards indicating either that (i) the restaurant or retail food store is in compliance with the regulations promulgated pursuant to this section; (ii) the restaurant's or retail food store's license to operate is under administrative review by the Department; or (iii) the restaurant's or retail food store's license has been suspended or revoked. The provisions of the Administrative Process Act does not apply to the adoption of any regulation pursuant to this bill, but does require the Departments of Agriculture and Consumer Services and Health to publish an opportunity for public comment on the proposed regulations.
