SUMMARY AS PASSED:

Juvenile DUI and refusal. Gives the court the discretion to discharge and dismiss DUI and refusal proceedings against a juvenile. Under current law when a juvenile is found to have committed a violation of the DUI statute or to have unlawfully refused a blood test the court must dismiss the proceedings when the license has been restored and the terms and conditions have been met unless the violation resulted in the injury or death of any person.

SUMMARY AS PASSED HOUSE:

Juvenile "zero tolerance". Provides that the court may discharge and dismiss a juvenile charged with drunk driving or refusal to submit to a blood or breath test without the current requirement of a suspension of license or probation. The bill also allows the court to impose any disposition currently available for a delinquent child to also include a child charged with refusing a blood or breath test under the juvenile "zero tolerance" law.

SUMMARY AS INTRODUCED:

Abuse and lose; deferred findings. Repeals the provisions requiring a deferred finding in juvenile cases of drunk driving and refusal to submit to blood or breath tests.
