Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 56-559.1 as follows:

§ 556-559.1. Procedures to be followed when responsible public entity solicits proposals.

Whenever a responsible public entity solicits proposals for the construction of a transportation facility under this chapter, all proposals received shall be reviewed and, based upon this review, the most promising 30 percent of proposals submitted or the 3-most promising proposals submitted, whichever is the fewer, shall be selected for more detailed review and negotiations before a comprehensive agreement is concluded. The private entities whose proposals are identified as being among the 30 percent or 3-most promising proposals shall, if no comprehensive agreement is reached with them, be reimbursed by the responsible public entity for their actual costs incurred in preparing and submitting their proposals, but such reimbursement shall not include any allowance for profit. All such reimbursements shall be subject to audit by the Auditor of Public Accounts.
