Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-36.2 as follows:

§ 18.2-36.2. Disobeying [ a lane direction control signal a traffic signal ] ; involuntary manslaughter.

Any person who intentionally violates the provisions of § [ 46.2-805 46.2-833 ] is guilty of a Class 1 misdemeanor. In the event that such intentional violation results in the death of another person, such offender is guilty of involuntary manslaughter.

The provisions of this section shall not preclude the applicability of any other provision of the criminal law of the Commonwealth that may apply to any course of conduct that violates this section.

2. That the provisions of this act may result in a net increase in periods of imprisonment or commitment. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation cannot be determined for periods of imprisonment in state adult correctional facilities and cannot be determined for periods of commitment to the custody of the Department of Juvenile Justice.
