Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 63.1-110.2 as follows:

§ 63.1-110.2. TANF child support disregard.

To the extent permitted by federal law, the Department shall pay the state's share of current child support, collected under the assignment required as a condition of eligibility for TANF cash assistance, to current recipients of TANF cash assistance. Such child support payments shall be disregarded in determining (i) eligibility for TANF cash assistance and medical assistance services and (ii) the amount of the TANF cash assistance payment.
