038068668Be it enacted by the General Assembly of Virginia:
1. That § 63.2-905 of the Code of Virginia is amended and reenacted as follows:
§ 63.2-905. Foster care services; transition services.
A. Foster care services are the provision of a full range of casework, treatment and community services for a planned period of time to a child who is abused or neglected as defined in § 63.2-100 or in need of services as defined in § 16.1-228 and his family when the child (i) has been identified as needing services to prevent or eliminate the need for foster care placement, (ii) has been placed through an agreement between the local board or the public agency designated by the community policy and management team and the parents or guardians where legal custody remains with the parents or guardians, or (iii) has been committed or entrusted to a local board or licensed child placing agency.
B. The Department shall develop and implement a program of transition services for those children who continue to be in foster care as adolescents and for those young adults age 18 to 23 who exit foster care to provide these children and young adults with independent life skills and education that will allow them to assume personal responsibility for becoming self-sufficient adults. For older children in foster care, transition services shall not be an alternative to adoption, but shall occur concurrently with efforts to locate and achieve placement with adoptive parents. In order to evaluate the success of such transition services, the Department shall develop outcome measures and other performance measures for the program. The Department shall work with other state agencies to maximize funding and facilitate interagency support for such services as is appropriate.
