Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 24.2-702.2 as follows:

§ 24.2-702.2. Pilot program for certain uniformed and overseas citizens to transmit absentee ballots electronically and by the Internet.

The State Board may establish, in cooperation with the Federal Voting Assistance Program, a pilot program to be implemented in 2004 in one or more counties or cities or on a statewide basis to permit persons entitled to register and vote in federal elections pursuant to the Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C. § 1973ff et seq.) to transmit their absentee ballots to the State Board or appropriate local electoral board over an electronic medium using the Internet. The State Board shall rely on procedures established by the United States Department of Defense for security, secrecy, and validation of ballots and shall not be subject to civil liability or criminal penalty for following these procedures.
