Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.2-4303.1 as follows:

§ 2.2-4303.1. Method of procurement; multiphase contracts for professional services for construction and infrastructure projects in certain cities.

Notwithstanding any provision contained in this chapter to the contrary, in any city with a population of more than 400,000, multiphase contracts for professional services satisfactory and advantageous to such city for environmental, location, study, design, or inspection work relating to construction or infrastructure projects, may be negotiated and awarded based on a fair and reasonable price for the first phase only, when completion of the first phase is necessary to provide information critical to the negotiation of a fair and reasonable price for succeeding phases. Prior to the procurement of any such contract, the city shall determine in writing that the nature of the work is such that the best interests of the city require awarding the contract authorized by this section.
