SUMMARY AS PASSED:

Aggressive Driving; offense and penalty. Creates the new offense of aggressive driving and provides that a person is guilty of aggressive driving if he violates one or more of an enumerated list of traffic violations, e.g., following too closely, failure to observe lanes marked for traffic, stopping on highway, etc., with the intent to harass, intimidate, injure or obstruct another person. Aggressive driving shall be punished as a Class 2 misdemeanor, however, aggressive driving with the intent to injure another person shall be punished as a Class 1 misdemeanor. This bill is identical to HB 1342.

SUMMARY AS PASSED SENATE:

Aggressive driving; penalty. Creates the new offense of aggressive driving, which is punishable as a Class 2 misdemeanor and is assigned four demerit points. A person is guilty of aggressive driving if he commits certain traffic infractions with the intent to harass, intimidate, injury or obstruct another person or is a hazard to another person.

SUMMARY AS INTRODUCED:

Aggressive driving; penalty. Creates the new offense of aggressive driving, which is punishable as reckless driving (Class 1 misdemeanor) but may not be reduced to improper driving and is assigned four demerit points.
