Bad checks; notice of nonpayment. Allows an affidavit of service of mailing to be used when a notice to the drawer is sent by regular mail in a civil action for giving a bad check.

SUMMARY AS INTRODUCED:
Bad checks; notice of nonpayment. Permits the payee of a dishonored check to send a notice of nonpayment to the maker or drawer of the check by regular mail supported by an affidavit of service by mailing. Currently, such notices must be sent by certified or registered mail, return receipt requested. Such notices are used in criminal prosecutions of bad check laws as evidence of the maker's or drawer's intent to defraud or knowledge that his account had insufficient funds. The measure also allows an affidavit of service by mailing to be used when a notice to the drawer is sent by regular mail in a civil action for giving a bad check.
