SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION: (all summaries)
Custody and visitation. Provides that in any case in which custody or visitation of a child is at issue, any information obtained during therapy and the records kept by any licensed mental health care provider concerning a parent shall be privileged and confidential. Additionally, a mental health care provider may not be required to testify on behalf of or against a parent or adult relative of the parent except that the court may order the provider to testify on child abuse matters. The privilege and confidentiality provisions do not apply to providers who have conducted or are conducting an independent mental health evaluation pursuant to a court order. The bill is effective July 1, 2003.
