027287884Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 46.2-1143.1 as follows:
§ 46.2-1143.1. Department of Forestry to calculate the average weight of timber; vehicles used to haul timber to bear certain markings; provisions of § 46.2-1143, including penalties, to apply, mutatis mutandis, to vehicle used to haul timber.
The Department of Forestry shall calculate the average weight of timber, expressed in pounds per cubic foot.
Owners of vehicles used to haul timber may apply to the vehicles at levels where, when the vehicle is loaded to that level, the cubic volume of the load multiplied by the average weight of timber as calculated by the Department of Forestry, is no greater that the maximum weight for that type vehicle authorized under § 46.2-1143.
The Commonwealth Transportation Commissioner and local authorities of cities and towns in their respective jurisdictions, upon written application by the owner or operator of vehicles used exclusively for hauling timber shall issue, without cost, a permit authorizing those vehicles to operate with gross weights authorized by permits issued under § 46.2-1143.
The provisions of § 46.2-1143 shall apply, mutatis mutandis, to vehicles hauling timber under permits issued as provided in this section.
