027260736Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 36-105.001 as follows:
§ 36-105.001. Expiration of permits.
Any permit issued pursuant to the Building Code shall be valid for a period of one year from the date of issuance. Any person issued a permit may submit a written request to the local building official for an extension of the permit provided the request is made prior to the expiration date of the permit or within the thirty-day period following the expiration date. The local building official shall review the permit extension request to ascertain whether (i) the conditions under which the permit was originally issued remain the same, and (ii) substantial work has progressed under the original permit. Based on his review, the local building official shall determine whether the extension shall be granted. In no event shall any permit extension request be granted after three years from the date of the original issuance of the permit.
