Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 3 of Chapter 3 of Title 8.01 a section numbered 8.01-44.6, as follows:

§ 8.01-44.6. Limited liability of railroad corporations.

In any suit for personal injuries, a railroad corporation is not liable for damages to a third party if it is determined that a defendant, other than the railroad corporation, violated the provisions of Article 9 (§ 46.2-884 et seq.) of Chapter 8 of Title 46.2.
