, provided, that a violation of this chapter shall not, of itself, (i) serve as the basis for a civil action in negligence, (ii) be considered in mitigation of damages of whatever nature, (iii) be admissible in evidence or (iv) be the subject of comment by counsel in any action for the recovery of damages arising out of the use of an amusement device
