        However, no locality can spend any of the revenue distributed under this section without meeting the following condition: the locality shall conduct a lottery for the public school students in the locality for the purpose of selecting students who would choose to exit the public school system to be otherwise in compliance with the compulsory school attendance law. The parents, custodial parents, or legal guardians of the students selected through the lottery shall receive from the locality a voucher or a tax credit against the local real estate tax in an amount not less than one-third or more than one-half of the average per-pupil expenditures in that school division. The locality would still receive the state share of funding for the students selected by the lottery and choosing to exit the public school system to be otherwise in compliance with the compulsory school attendance law.

        However, no locality using temporary classrooms in its public school system can spend any of the revenue distributed under this section without meeting the following condition: the locality shall conduct a lottery for the public school students in the locality for the purpose of selecting students who would choose to exit the public school system to be otherwise in compliance with the compulsory school attendance law. The parents, custodial parents, or legal guardians of the students selected through the lottery shall receive from the locality a voucher or a tax credit against the local real estate tax in an amount not less than one-third or more than one-half of the average per-pupil expenditures in that school division.
