M. Pursuant to the provisions of the Public Private Transportation Act of 1995, § 56-556 et. seq., Code of Virginia, the Department of Transportation may issue a notice to proceed with Section A of the Coalfields Expressway provided such funding committed to such project does not exceed funding available from the Appalachian Regional Commission for such project and the required State match to those federal funds, FRANS designated for the Project under the VTA 2000, and such other funds available to the Commonwealth Transportation Board appropriated by the General Assembly.
