Summonses issued by attorneys. Repeals the clause that provided that House Bill 1213 from the 2000 General Assembly Session expires on July 1, 2001. House Bill 1213 provided that an attorney may issue a summons not less than five business days prior to the date attendance is desired in a civil proceeding pending in a court or at a deposition in connection with such proceeding. An attorney-issued summons is required to be on a form approved by the Supreme Court, signed by the attorney, and to include the attorney's address. The attorney-issued summons is deemed to be a pleading. Attorneys are also allowed to issue subpoenas duces tecum. This bill is identical to HB 2366 (O'Bannon).
