SUMMARY AS INTRODUCED:
Underground Utility Damage Prevention Act; measure of damages. Eliminates a provision providing that the amount an operator may recover for damage to underground facilities is the cost to repair the facilities as that cost is normally computed by the operator. In its place, an operator whose facilities are damaged as a proximate result of a person's failure to comply with the Act will be the actual costs incurred in repairing the damaged facilities. The measure of damages that an excavator may recover from an operator who fails to comply with the Act will be the actual cost incurred in repairing any damage to the excavator's equipment or facilities.
