SUMMARY AS PASSED:

Powers and duties of Commonwealth Transportation Board (CTB). Allows the Commonwealth Transportation Board to award contracts for the construction of transportation projects on a design-build basis. The Board may annually award five design-build contracts valued at no more than $20 million. The Board may also award design-build contracts valued at more than $20 million, provided that no more than five of these latter contracts are in force at the same time. The bill also requires the CTB to recommend to the General Assembly objective criteria to be used by the CTB in selecting those transportation projects to be advanced from the feasibility to the construction stage. These criteria must include requirements for prequalification of contractors and competitive bidding processes. The contracts have to be of such size and scope as to encourage competition. If such criteria are enacted into law, the criteria will apply to the interstate, primary, and urban systems of highways.

The Board may also award design-build contracts valued at more than $20 million, provided that no more than five of these latter contracts are in force at the same time. The bill also requires the CTB to recommend to the General Assembly objective criteria to be used by the CTB in selecting those transportation projects to be advanced from the feasibility to the construction stage. If such criteria are enacted into law, the criteria will apply to the interstate, primary, and urban systems of highways. One technical amendment to this bill will make it identical to HB 2048 (Robinson), as reported from the Senate Transportation Committee.

SUMMARY AS INTRODUCED:

Powers and duties of Commonwealth Transportation Board (CTB). Allows the annual awarding of up to 10 design-build transportation project contracts by the CTB (five up to $20 million, five of more than $20 million), subject to a written determination by the Commonwealth Transportation Commissioner in each case that so doing is in the best public interest. The bill also makes the CTB responsible for criteria for advancing transportation projects from the feasibility stage to the construction stage.
